Illinois became the eleventh state to legalize recreational adult use cannabis on January 1, 2020 and with it still comes uncertainty for law enforcement and the court system. Criminal Defense Attorney Scott McClintock advises those partaking in the legalization of cannabis to abide in the same laws as alcohol:

“If you wouldn’t do it with alcohol, most likely you are not doing it with marijuana. Drinking in public, smoking in public. Not allowed. Carrying it in a container in your car, for instance, or unauthorized container. You don’t put it in your solo cup at home and then it makes everything okay, you still can’t have open alcohol, you can’t have open marijuana in your car. Can’t be using it while driving. That is pretty much the general rule of thumb,” Scott McClintock states.

Residents of Illinois 21 and older can legally possess up to 30 grams of marijuana, 500 mg of THC infused products, and 5 grams concentrate. People from out of state can legally possess only half of those amounts.
