Rosenbalm Sentenced on Six Felony Counts in Warren County

On August 7, 2024 Brandon E. Rosenbalm, 42, was sentenced on six felony counts arising out of two separate cases in Warren County. At his April 17, 2024 trial he took the stand in his own defense, partially blaming his daughter for the January 2024 incident. After viewing a cell phone video of part of the event, the jury rejected Rosenbalm’s account and found him guilty of four separate offenses. He was convicted of Aggravated Domestic Battery of his 16 year old daughter; a separate instance of felony Domestic Battery against the child; a count of felony Domestic Battery against his paramour, and finally, one count of Criminal Damage to Property in the amount of $1,000.

The defendant had been on probation at the time for a January, 2021 incident where he kicked a Warren County Sheriff’s Deputy in the face, resulting in a trip to the ER for the officer. He pled guilty to Aggravated Battery/LEO, Domestic Battery, and Resisting an Officer/Injury in that case. A charge of Driving Under the Influence was dismissed in connection with the plea. During the arrest, he refused to provide a chemical sample; a warrant for his blood was obtained, and the results revealed that Rosenbalm had cocaine and THC in his system and that his BAC was .125. The legal limit is .08.

The Court also heard about  several other incidents involving the defendant, including one in 2014 where he kicked Monmouth Police Officer Joe Bratcher. Since January of 2021, the defendant pled guilty on separate occasions to two Battery cases arising from separate incidents, and Permitting a Minor to Become Intoxicated. The defendant had previously been found in violation of his probation for using illegal drugs. While awaiting trial for choking his daughter, he directed a witness to refuse to comply with a subpoena, resulting in additional felony charges.

The defendant was sentenced to 7 years to be served at “85%” for Aggravated Domestic Battery and he was re-sentenced to 5 years, to be served at “50%” on his most recent probation violation. He was handed sentences of 2 years on each of his other four counts, with all sentences to be served concurrently. He was given 188 days credit for time served while awaiting trial and sentencing, meaning he will likely serve a little more than 5 more years. After he has served his time, he will be on Mandatory Supervised Release (parole) for four years. Based on the sentences imposed, charges for witness tampering were dismissed.
